Gavin Mellor, the prison inmate who requested the Home Secretary to allow him access to fertility treatment in order that he would be able to artificially inseminate his wife, has lost his appeal case at the House of Lords.
Mellor, who is serving a life sentence for murder at Nottingham prison, challenged the initial refusal almost 18 months ago, but the judicial review found that the Home Secretary's decision was neither irrational nor unreasonable. Later, Mr Mellor argued at the Court of Appeal that the decision contravened his human rights to found a family, but the judges found that one of the purposes of imprisonment was to deprive people of certain rights and freedoms, including the pleasures of family life and the exercise of conjugal rights.
